1. Provider

RideAnimator (rideanimator.com) is provided by Alexander Haselhoff, Krummenackerstr. 10, 70329 Stuttgart, Germany (“we”). Contact: info@rideanimator.com.

2. The service

RideAnimator is a web app for motorcyclists. It plans motorcycle tours, exports them as GPX and creates animated map videos of them. Videos are made in your browser on your device. Using RideAnimator is free.

3. Your content and your videos

You are responsible for the photos, clips, music, texts and places you use, and for having the rights to them. The videos you make are yours. You may use them privately and commercially (for example on YouTube). Map data © OpenStreetMap contributors must stay credited as shown in the video.

4. Planned routes and riding

Routes are calculated automatically from OpenStreetMap data. They can contain errors, closed or unsuitable roads, gravel or private roads, and they do not know current conditions. Check every route before you ride, follow traffic rules and signs, and ride at your own responsibility.

5. Publishing in the community

When you publish a tour, you confirm that you have the rights to the video, the music and the pictures in it, and that people who can be recognised in it agree. You grant us the non-exclusive, free right to show the tour, its video, picture and GPX file on rideanimator.com and to let other riders download the GPX and load the route into the planner, until you withdraw it. You can withdraw a tour at any time with one click. We may remove tours that break the law or these terms, or that are clearly not motorcycle tours, without notice. Ratings must be honest; please rate only tours you know.

6. Availability

We work to keep RideAnimator available, but cannot guarantee uninterrupted service. Features may change and be improved. Paid options that you have already bought keep their promised scope for their term.

7. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for the breach of essential contractual obligations, limited to the damage typical for this kind of contract. Liability under the German Product Liability Act remains unaffected.

8. Law

German law applies. If you are a consumer, the mandatory consumer protection rules of the country where you live also apply.

2. Leistung

RideAnimator ist eine Web-App für Motorradfahrer. Sie plant Motorradtouren, exportiert sie als GPX und erstellt animierte Kartenvideos davon. Die Videos entstehen in deinem Browser auf deinem Gerät. Die Nutzung ist kostenlos.

3. Deine Inhalte und deine Videos

Du bist für die Fotos, Clips, Musik, Texte und Orte verantwortlich, die du verwendest, und dafür, die Rechte daran zu haben. Die Videos, die du erstellst, gehören dir. Du darfst sie privat und gewerblich nutzen (zum Beispiel auf YouTube). Der Hinweis auf die Kartendaten © OpenStreetMap-Mitwirkende muss so erhalten bleiben, wie er im Video steht.

4. Geplante Routen und Fahren

Routen werden automatisch aus OpenStreetMap-Daten berechnet. Sie können Fehler, gesperrte oder ungeeignete Straßen, Schotter- oder Privatwege enthalten und kennen die aktuelle Lage nicht. Prüfe jede Route vor der Fahrt, beachte Verkehrsregeln und Beschilderung und fahre in eigener Verantwortung.

5. Veröffentlichen in der Community

Wenn du eine Tour veröffentlichst, bestätigst du, dass du die Rechte an Video, Musik und Bildern darin hast und dass erkennbare Personen einverstanden sind. Du räumst uns das einfache, unentgeltliche Recht ein, die Tour mit Video, Bild und GPX-Datei auf rideanimator.com zu zeigen und anderen Fahrern das Herunterladen der GPX-Datei und die Übernahme in den Planer zu ermöglichen, bis du sie zurücknimmst. Du kannst eine Tour jederzeit mit einem Klick zurücknehmen. Touren, die gegen Gesetze oder diese Bedingungen verstoßen oder erkennbar keine Motorradtouren sind, dürfen wir ohne Ankündigung entfernen. Bewertungen müssen ehrlich sein; bewerte bitte nur Touren, die du kennst.

6. Verfügbarkeit

Wir bemühen uns, RideAnimator verfügbar zu halten, können einen unterbrechungsfreien Betrieb aber nicht garantieren. Funktionen können sich ändern und verbessert werden. Bereits gekaufte Optionen behalten für ihre Laufzeit den zugesagten Umfang.

7. Haftung

Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten, begrenzt auf den vertragstypischen, vorhersehbaren Schaden. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

8. Recht

Es gilt deutsches Recht. Bist du Verbraucher, gelten zusätzlich die zwingenden Verbraucherschutzvorschriften des Landes, in dem du lebst.

RideAnimator es una aplicación web para moteros. Planifica rutas en moto, las exporta como GPX y crea vídeos de mapas animados de ellas. Los vídeos se crean en tu navegador, en tu dispositivo. Usar RideAnimator es gratis.

3. Tu contenido y tus vídeos

Eres responsable de las fotos, clips, música, textos y lugares que usas, y de tener los derechos sobre ellos. Los vídeos que creas son tuyos. Puedes usarlos de forma privada y comercial (por ejemplo en YouTube). La mención © colaboradores de OpenStreetMap debe mantenerse tal como aparece en el vídeo.

4. Rutas planificadas y conducción

Las rutas se calculan automáticamente con datos de OpenStreetMap. Pueden contener errores, carreteras cortadas o inadecuadas, pistas de tierra o caminos privados, y no conocen el estado actual. Revisa cada ruta antes de salir, respeta las normas y la señalización y conduce bajo tu propia responsabilidad.

5. Publicar en la comunidad

Al publicar una ruta confirmas que tienes los derechos sobre el vídeo, la música y las imágenes, y que las personas reconocibles están de acuerdo. Nos concedes el derecho no exclusivo y gratuito de mostrar la ruta con su vídeo, imagen y archivo GPX en rideanimator.com y de permitir a otros moteros descargar el GPX y cargar la ruta en el planificador, hasta que la retires. Puedes retirarla en cualquier momento con un clic. Podemos eliminar sin aviso rutas que infrinjan la ley o estas condiciones, o que claramente no sean rutas en moto. Las valoraciones deben ser honestas; valora solo rutas que conozcas.

6. Disponibilidad

Trabajamos para que RideAnimator esté disponible, pero no podemos garantizar un servicio sin interrupciones. Las funciones pueden cambiar y mejorar. Las opciones de pago ya compradas mantienen su alcance durante su plazo.

7. Responsabilidad

Respondemos sin límite en caso de dolo y negligencia grave, así como por daños a la vida, al cuerpo o a la salud. En caso de negligencia leve solo respondemos por el incumplimiento de obligaciones contractuales esenciales, limitado al daño típico y previsible de este tipo de contrato. La responsabilidad según la ley alemana de responsabilidad por productos no se ve afectada.

8. Ley aplicable

Se aplica el derecho alemán. Si eres consumidor, también se aplican las normas obligatorias de protección del consumidor del país donde vives.
